Coleman's St. Paul budget would hike fees on top of property taxes

On top of tax hikes, St. Paul Mayor Chris Coleman's 2012 budget proposal Monday mentioned "non-property tax revenue" - in other words, fee increases - to help make up for cuts to state aid and other fiscal pressures.

The proposed fee increases would add up to as much as $79 in new costs for the typical homeowner next year. That's nearly double the impact of Coleman's proposed 6.5 percent increase in the city's property tax levy.

It's not likely to be a popular idea at a time when many homeowners say they're hurting because of unemployment and the lingering effects of the recession. Nevertheless, snowplows need replacing, and employee health care costs are going up. Without funding, core services such as roadwork and public

safety begin to falter. And city officials say they've kept spending relatively flat.

"Given all the challenges at the state Legislature and other things that are happening in the economy, this is a budget that is not without pain," city budget manager Steve Cordes told the St. Paul City Council on Wednesday, "but (it) is a fiscally prudent and forward-looking budget."

Residents owning homes valued at $155,000 today - the citywide median - would see their housing values drop 4 percent to $149,000 next year. Under the mayor's budget, those homeowners can expect to pay $1,235 in taxes and fees to St. Paul next year, compared with $1,110 this year.

The city's share of property taxes for those homeowners would go up $44, from $524 to

$568.

Water rates likely would rise from $204 to between $217 and $231.

A storm sewer charge would increase from $74 to $80. A sanitary sewer charge would go up $10.

And the city's recycling fee would increase from $32 to $54, with $18 of the $22 increase dedicated to curbside pickup of composting and clean organic materials. That program has been proposed by Eureka Recycling, the city's recycling contractor, but not finalized with St. Paul Public Works.

Some fees are specific to homes bordering particular types of street work. The typical street maintenance assessment - which applies to homes with street, sidewalk, streetlight maintenance and ash tree removal - would go up from $210 to $224.

City officials say homeowners and businesses won't be the only ones to foot the bill. The increased assessments apply to non-taxpaying properties such as colleges, nonprofits and tax-exempt businesses, as well.

Other increases are likely. For instance, all downtown parking meters could soon accept credit cards, an upgrade that could potentially be paid for by parking rate increases of 25 cents per hour.

net growth in city government," said Cordes, noting spending would increase overall by about 0.3 percent. "It's basically a flat budget."

Spending won't increase significantly, but employee health care costs are going up, while state aid - so-called Local Government Aid and reimbursements for a state-funded housing tax credit - are going down. Local Government Aid in 2002 comprised 40 percent of the city budget; it will now be 23 percent of the budget.

Most city employees will receive no cost-of-living-adjustment increases in 2012, but $800,000 in annual step increases in union salaries will occur as scheduled. Overall salary expenditures would go down from $124.3 million to $122.4 million because of a reduction in personnel.

Employee benefit costs would still go up from $51.6 million to $52.5 million, largely because of $2 million in health care increases.

The city's total 2012 budget would be $493.1 million, up from $491.7 million in 2011. The 2012 general fund budget of about $229 million drops $1.5 million, down 0.65 percent from this year's general fund budget of about $230.6 million.

In all, 56 positions would be reduced under the proposal, largely through vacancies and attrition.

"Right now, it's estimated that the layoff number would be under 20. That's going to shift a lot in the next few months," Cordes said. "People find new jobs. People leave city employment. It shifts the whole mix, and people end up bumping around each time that happens."

The proposed changes include a reduction of four civilian employees between the police and fire departments and a reduction of $500,000 in overtime for the fire department. Animal Control would lose two workers. Council members expressed concern that the Department of Safety and Inspections has been understaffed and would remain so for the foreseeable future.

The city maintains a AAA bond rating with Standard & Poor's and Aa1+ with Moody's, two of the largest credit-rating agencies.

That's "better credit than the federal government," Cordes said.

The city council and mayor have until the end of the year to approve a 2012 budget.

The council's budget committee meets at 10 a.m. Wednesdays in Room 330 of City Hall.

Courts deluged with shutdown cases

In the tricky world of government shutdown, Minnesota courts are being pulled into a big political, legal and constitutional mess. While both sides in the budget impasse have busily engaged in recrimination -- and occasional negotiation -- they also have brought their problems to the courts to settle what should or shouldn't happen if there's a shutdown. The result is a rousing battle over separation of powers.

Don Davis EchoPress_ST. PAUL -- Minnesota state government is focused on a Thursday court hearing about what could remain open during a government shutdown.

No high-level budget talks have convened for six days as top policymakers remain in a deadlock over a new two-year budget, but the governor and legislative leaders plan an afternoon meeting today.

Short of a last-minute surprise or the governor and lawmakers agreeing to temporarily continue some form of the current budget, at least a partial government shutdown will begin on July 1.

The courts likely will decide, among hundreds of other issues, if state troopers patrol the roads, if local governments receive state aid, if nursing homes are paid and if the Minnesota Sex Offender Program operates. When and how those decisions will be made is up to Chief Judge Kathleen Gearin of Ramsey County District Court, who will convene a Thursday hearing.

That hearing could be crowded as groups keep requesting to be part of the shutdown court case.

On Tuesday, the House Rules Committee voted to be part of the case.

The committee approved, on a divided vote, a resolution allowing Republican leadership to hire former state Chief Justice Eric Magnuson to represent the House.

“Our interest is very narrow and limited in scope,” House Majority Leader Matt Dean, R-Dellwood, said.

Magnuson’s job is to make sure the courts do nothing to prevent the House from operating and to oppose Democratic Gov. Mark Dayton’s proposal for the court to order a mediator get involved in the budget impasse.

A House Republican caucus spokeswoman said Magnuson and the House still are negotiating terms of an agreement, so it is not known how much he will cost the state.

Magnuson’s pay will come from $4 million the House has in the bank, money that will not take a court’s approval to be spent.

The equivalent Senate panel passed a similar resolution last week.

Most departments would be out of money July 1 without a budget, so Dayton and Attorney General Lori Swanson last week asked the courts to allow the state to spend money even though the current budget expires June 30.

Dayton presented a detailed list of what he wants to stay open in a shutdown, and would keep more than a third of the executive branch’s 38,500 employees on the payroll.

The shutdown is likely because Republicans who control the Legislature and Dayton have not agreed on a budget for the two years beginning July 1. Republicans say they will spend no more than $34 billion, while Dayton wants a $35.8 billion target. Besides disagreeing on how much to spend, they also disagree on how the money should be spent.

The courts asked to be funded during a shutdown and a Monday hearing has been set by retired judge Bruce Christopherson of Yellow Medicine County to consider the request.

However, four Republican senators told the courts that judges have no authority to allow any state spending.

Sens. Scott Newman of Hutchinson, Sean Nienow of Cambridge, Warren Limmer of Maple Grove and Roger Chamberlain of Shoreview asked the courts to order Dayton to call a special legislative session so lawmakers can pass a budget. Other than a bill funding agriculture programs, Dayton vetoed the Republican-written budget bills passed in the regular legislative session that ended nearly a month ago and no progress has been made on new budget plans.

The Supreme Court gave the senators and attorney general until 11 a.m. today to file more documents, with Justice Allan Page saying the case will be expedited.

Organizations of health-care providers have asked courts to keep their funding flowing and on Tuesday Ramsey County joined in supporting Dayton and Swanson’s requests for spending to continue.

Also on Tuesday, the state’s public defenders asked to keep their funding. Other groups are considering getting involved.

On Tuesday, the Minnesota State Colleges and Universities system announced that it is rescinding more than 6,000 layoff notices it sent to employees.

A quo warranto action is filed typically to remove a person from public office. The Attorney General must approve all quo warranto actions filed by private individuals. This protects public officers from frivolous lawsuits. Nature of Remedy.

A quo warranto action may be brought against any person who usurps, intrudes into, or unlawfully holds or exercises any public office or franchise.

A quo warranto action may also be brought against any corporation, either de jure or de facto, which usurps, intrudes into, or unlawfully holds or exercises any franchise within California.

The Opinion Unit reviews the written pleadings filed by the parties and issues an opinion either granting or denying the application to sue. If approval is given, the lawsuit is maintained under the direction of the Attorney General.

The prerogative writ of quo warranto has been suppressed at the federal level in the United States, and deprecated at the state level, but remains a right under the Ninth Amendment, which was understood and presumed by the Founders, and which affords the only judicial remedy for violations of the Constitution by public officials and agents. Here are a few writings on the subject. Revival of the writs must be combined with reviving standing for private prosecution of public rights, subverted by the "cases and controversies" doctrine and the decision in Frothingham v. Mellon, 262 U.S. 447 (1923), which is discussed in an article by Steve Winter, The Metaphor of Standing and the Problem of Self-Governance.

Quo warranto is intended to prevent a continuing exercise of an authority unlawfully asserted, and is not appropriate for moot or abstract questions. Where the alleged usurpation has terminated, quo warranto will be denied. (People v. City of Whittier (1933) 133 Cal.App. 316, 324; 25 Ops.Cal.Atty.Gen. 223 (1955).) By the same token, because quo warranto serves to end a continuous usurpation, no statute of limitations applies to the action. (People v.
