Coalition for Change in Minnesota Guardianship and Conservatorship Laws Successful in Creating a “Bill of Rights” for citizens under guardianship/ conservatorship A coalition of organizations and individuals who represent some of Minnesota’s most vulnerable citizens, has been working for the past three years to make improvements to Minnesota laws that govern the guardianship and conservatorship system in this state. Based on the numerous examples of problems in the system, the coalition identified a number of changes and began working for change. The first two years culminated with the Supreme Court Work Group that issued their report to the Legislature in January 2009. The Work Group did not propose specific legislation but a coalition of some of the Work Group members did. After a great deal of work with members of the legislature and other affected parties, HF 804 passed both bodies of the legislature this past week. Coalition members want to give thanks to the Minnesota Legislature who gave bi-partisan support to this bill. The coalition is especially grateful to the bill’s chief authors, Sen. Moua and Rep. Thissen, for their leadership in moving this bill through the legislature. There are over 22,000 guardianship/conservatorship cases in Minnesota. The majority of these cases are handled in a professional manner day in and day out, by hard working professional guardians/conservators and concerned family members. However, the cases where things were not handled appropriately has emphasized a need for improved oversight. In those cases, the well-being of the vulnerable adult, as well as their quality of life was significantly affected. House File 804 succeeded in • Created a “Bill of Rights” for protected persons; • Requires the guardian/conservator to file a statement of qualifications with the court; • Requires the Court to establish a Registration system by 2013; • Clarifies that the guardian cannot remove an authorized health care agent except in limited cases; • Allows for additional Interested Parties and directs the guardian/conservator to copy interested parties on reports; • Allows the protected person to seek court enforcement of their rights; and • Clarifies when an attorney representing the protected person might have a conflict of interest. The Coalition thanks all of those involved in this process for their ideas and their efforts on behalf of these vulnerable citizens.
